Terms of Service

The rules for using Textcierge, written in plain language. The short version: send account alerts, not ads, text only customers who agreed to hear from you, and cancel whenever you like.

Last updated October 30, 2026

Who these terms are with

These terms are an agreement between Textcierge Inc. ("Textcierge", "we", "us") and the business that signs up for a trial or a plan ("you"). They cover this website and the Textcierge software, including alerts, the shared inbox, keywords, automations, the API, delivery reports and AI reply drafts (together, the "Service").

The Service is for businesses only. If you sign up for a business, you confirm you have authority to accept these terms for it. You must be at least 18. The Service sends texts to mobile numbers in the United States and Canada only.

You can reach Textcierge Inc. by email at support@textcierge.com.

What the Service is for

Textcierge is built for account notifications: texts a financial company sends to its own customers about an account, product or transaction they already have. Examples include:

  • payment due, payment received and missed-payment notices
  • balance, deposit and low-balance alerts
  • card activity and fraud alerts, and the customer's YES or NO reply
  • sign-in and verification codes
  • statement-ready, document-request and application or loan status notices
  • service notices, such as planned downtime, and replies to questions the customer started

Promotional texts are not allowed on Textcierge plans. That includes rate offers, new product or card offers, refinance or loan solicitations, referral pushes and win-back messages. If the purpose of a text is to sell rather than to tell a customer something about their own account, send it another way.

Plans, credits and trials

We sell three monthly plans: Front Desk, Concierge and Grand. Each includes a monthly number of credits, a number of seats and keywords, unlimited contacts, free inbound texts and one sending number. Current prices and allowances are on the Pricing page.

  • One credit sends one text segment of up to 160 standard characters to one recipient. Longer texts, and texts with emoji or some special characters (limit 70 per segment), use more than one credit. A picture message (MMS) uses 3 credits. The composer shows the count before you send.
  • Credits are used when a text is handed to the carrier, whether or not the carrier delivers it. Inbound texts are free.
  • Unused credits roll over for one month on monthly plans and then expire. On yearly plans they roll over until the end of the yearly term.
  • A new account gets a 14-day trial with 50 credits and no card. Trial texts must follow these terms. We may change or end trials for new sign-ups at any time.

Billing, renewal and extra credits

  • Your plan is billed on the day it starts and renews automatically on that date every month, or each year on a yearly plan, until you cancel.
  • Credits used beyond your plan cost 4 cents each and are added to your next bill. You can set a cap in your account so sending stops at your allowance.
  • Carriers charge registration fees and per-message surcharges for business texting. We pass these through at cost, with no markup, as separate lines on your bill.
  • Prices do not include sales tax. Where tax applies, it is shown on your bill.
  • If we change a plan's price, we will email the account owner at least 30 days before your next renewal at the new price.
  • If you think a charge is wrong, tell us within 60 days of the bill. After that, the charge is final.

Canceling and refunds

You can cancel at any time from Settings, then Billing, then Cancel plan. Canceling stops the next renewal. You keep access until the end of the period you already paid for.

Paid periods, unused credits and carrier fees are not refunded, except where the law requires it. If we charge you by mistake, we will refund the mistaken amount.

You can change plans at any time. The new price and credits start on your next billing date.

Your account and your team

Keep sign-in details private, give each person their own seat, and turn on two-step sign-in. The account owner is responsible for activity by everyone on the account and for removing people who should no longer have access. Tell us right away if you think someone has used your account without permission.

Keep your business details current. We use them to register your sending number with carriers and to reach you about your account.

What you may not send

You may not use the Service to send:

  • promotional or marketing texts of any kind, as described above
  • loan solicitations or lead generation, including payday, short-term or high-interest loans, and offers of credit to people who are not already your customers
  • debt collection texts, or offers of debt relief, debt consolidation, credit repair or tax relief
  • investment tips, cryptocurrency promotions, or offers that promise income
  • content about cannabis, CBD, alcohol, tobacco, vaping, firearms, gambling or sweepstakes, or sexual content
  • anything illegal, deceptive, harassing or hateful, or that pretends to be another company
  • requests for passwords, PINs, full card or account numbers, or one-time codes, or links that lead to such requests
  • links through public link shorteners

Do not put full card numbers, full account numbers, Social Security numbers or passwords in text bodies, contact fields or files you upload. We may review texts flagged by our systems or by carriers to enforce this section, and you agree to pay any carrier fines caused by texts from your account.

Numbers and carrier registration

Each plan includes one toll-free or local (10DLC) number, or we can text-enable a number you already own. Before a number can send, we register it with carriers using the business details you give us, and carriers must approve it. Carriers decide whether and when to approve, and they may ask for changes or refuse a registration. You agree that the details you give us are true.

A number we provide stays assigned to your account while your plan is active. If you want to keep it after you leave, ask us to help you port it before your plan ends, and we will not hold it back if your account is paid up. Numbers on closed accounts may be released 30 days after the plan ends. Keywords stay with the Service and may be reassigned after your plan ends.

Delivery

Texts travel through wireless carriers we do not control. Carriers can delay, filter or block texts, and we cannot guarantee that every text is delivered or delivered on time. Delivery reports show what carriers tell us. Do not rely on text alone for notices the law requires you to deliver, and keep another channel for urgent alerts.

AI reply drafts

AI features suggest replies, summarize threads and sort the inbox. They never send a text on their own. A person on your team reviews and sends every text, and you are responsible for what you send. Suggestions can be wrong, so check facts such as amounts and dates first. Our AI providers may not train their models on your content. You can turn AI features off for your whole account.

Fair use of the software

Please do not copy, resell or sublicense the Service; reverse engineer it; scrape it; test its security without written permission; or use it in a way that degrades it for other customers. Accounts that send unusually high volumes in a short time, or that have a high rate of failed texts, may be paused while we confirm the traffic is legitimate.

Who owns what

You own your contacts, your texts and everything else you put into Textcierge ("Your Content"). You let us store, process and transmit Your Content only as needed to run the Service for you, keep it secure and meet legal obligations. We act as your service provider for Your Content, and you remain responsible for your own duties under financial privacy and security laws.

We own the Textcierge software, website and brand. If you send us suggestions, we may use them without owing you anything.

Suspension and closing an account

We may pause or close an account if a payment fails and is not fixed within 14 days of our notice, if texts from the account break these terms, if a carrier requires it, or if continuing would expose you, us or recipients to legal risk. Where we reasonably can, we will tell you first and give you a chance to fix the problem.

After an account closes, you have 30 days to export your contacts, consent records and message history from Settings, then Export. After that we delete them as described in our Privacy Policy.

What we do not promise

We aim for 99.9 percent monthly uptime, but we provide the Service as is and as available. We do not promise that it will be uninterrupted or error free, that every text will be delivered, or that your use of it will meet the laws that apply to you. You decide what you send and to whom.

If a claim is made about your texts

You will defend and pay for claims brought against Textcierge by recipients, carriers or regulators that arise from texts you sent, your contact lists or consent records, or your breach of these terms, including fines and reasonable legal fees. We will tell you promptly about any such claim and let you control the defense.

Limits on liability

To the extent the law allows, neither of us is liable for indirect, incidental, special or consequential losses, such as lost profits or lost business. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim arose. These limits do not apply to your payment obligations or your obligations under the section above, or to liability that cannot be limited by law.

Resolving disagreements

If you have a problem with the Service, email support@textcierge.com first and give us 30 days to try to fix it. If we cannot, the dispute will be settled by binding individual arbitration under the Commercial Arbitration Rules of the American Arbitration Association, held in Delaware or by video. Either of us may instead bring a qualifying claim in small claims court, or ask a court to stop misuse of intellectual property.

Claims must be brought individually, not as part of a class or representative action. A claim must be brought within one year after it arose. These terms are governed by the laws of the State of Delaware.

Changes to these terms

We may update these terms as the Service changes. If a change materially affects your rights, we will email the account owner at least 14 days before it takes effect. The date at the top shows when these terms were last changed. Sections that by their nature should continue after an account closes, such as payment, ownership, indemnity, liability and disputes, continue.
